GNU 약소 일반 공중 라이선스의 이름으로 공표된 최초의 버전이다. 본 라이선스는 GNU 라이브러리 일반 공중 라이선스 버전2의 후속판으로 간주되기 때문에 버전 번호를 2.1로 붙인 것이다.

대부분의 소프트웨어에 대한 라이선스는 소프트웨어를 공유하거나 수정할 있는 자유를 제한하기 위해 고안되었다. 반면에 GNU 일반 공중 라이선스들은 자유 소프트웨어를 공유하고 수정할 있는 자유를 보장하기 위해 의도되었다. , 소프트웨어가 사용자 모두에게 자유롭게 이용될 있도록 하는 것이다.

라이선스, GNU 약소 일반 공중 라이선스는 자유소프트웨어 재단이나 기타 저작자의 소프트웨어 중에서 주로 라이브러리와 같이 특수하게 고안된 일부 소프트웨어 패키지에 적용된다. 누구나 자신의 프로그램에 라이선스를 적용시킬 있지만, 어떤 특정한 경우에 라이선스와 일반 공중 라이선스 어떤 것을 사용하는 편이 좋은지에 대해 아래와 같은 설명을 기준으로 먼저 신중하게 고려하기 바란다.

자유 소프트웨어라는 말에서 사용되는 자유free’라는 단어는 무료라는 금전적인 의미가 아니라 자유를 의미한다. GNU 일반 공중 라이선스들은 자유 소프트웨어의 복제본을 배포하고, 원한다면 판매도 있는 자유를 보장하기 위해 고안되었다. 또한 소스 코드를 받거나 구할 있고, 소프트웨어를 수정하거나 그것의 일부를 새로운 자유 프로그램 내에서 사용할 있으며, 이상과 같은 일들을 있다는 사실을 있도록 보장하고 있다.

당신의 권리를 보호하기 위해, 우리는 다른 사람이 당신의 이러한 권리를 부정하거나 당신의 권리를 포기하도록 요구하는 행위를 금지하기 위한 규정을 만들어야 한다. 이러한 규정들은 당신이 소프트웨어의 복제본을 배포하거나 수정할 경우에 당신에게도 특정한 의무를 부과한다.

자유 소프트웨어 재단은 다음과 같은 가지 단계를 통해서 당신의 권리를 보호한다: (1) 라이브러리의 저작권을 설정하고, (2) 라이선스를 제공함으로써 라이브러리를 복제, 배포, 수정할 있는 법적 권한을 부여한다.

또한, 배포자들을 보호하기 위해 자유 라이브러리에 대해 어떠한 보증도 제공되지 않는다는 점을 명확히 밝히고자 한다. 라이브러리가 누군가 다른 사람에 의해 수정되고 또다시 다른 사람에게 양도되는 경우, 우리는 수취인이 자신이 받은 소프트웨어가 원본이 아니라는 사실을 있기를 원한다. 다른 사람에 의해 야기된 어떤 문제도 저작자의 명성에 영향을 미치는 일이 없도록 하기 위해서이다.

마지막으로, 모든 자유 프로그램은 소프트웨어 특허에 의해 지속적인 위협을 받고 있다. 우리는 어떤 기업이 특허를 소유한 자로부터 제한적인 사용허가를 받음으로써 결과적으로 자유 프로그램의 사용자들의 활동을 규제하는 일이 없기를 희망한다. 따라서 라이브러리의 특정 버전에 대한 어떠한 특허 라이선스의 취득도 라이선스에서 규정하는 사용상의 자유를 완전히 만족시키는 범위 내에서 한다고 요구한다.

몇몇 라이브러리를 포함한 대부분의 GNU 소프트웨어에는 GNU 일반 공중 라이선스가 적용된다. 본 라이선스, GNU 약소 일반 공중 라이선스는 특수하게 고안된 라이브러리에 적용되며, GNU 일반 공중 라이선스와는 상당히 다른 면을 가지고 있다. 본 라이선스는 특정 라이브러리가 자유 소프트웨어가 아닌 프로그램과 함께 링크되는 것을 허용하려는 목적으로 사용된다. 

어떤 프로그램이 라이브러리와 함께 링크되면, 그 라이브러리가 정적으로 링크되든지 공유 라이브러리로 사용되든지 간에, 이 두 개의 조합은 법적으로 볼 때 결합저작물, 즉 최초의 라이브러리로부터 파생된 2차적 저작물로 간주된다. 따라서 일반 공중 라이선스는 결합된 전체 저작물이 일반 공중 라이선스가 규정하는 자유의 기준을 충족할 때에 한해서만 이러한 링크를 허용한다. 그러나 약소 일반 공중 라이선스는 라이브러리와 다른 코드의 링크에 대해서 보다 유연한 기준을 허용하고 있다.

본 라이선스를약소일반 공중 라이선스라고 부르는 이유는 사용자의 자유를 보호하는 정도를 보통의 일반 공중 라이선스보다 경감시켰기 때문이다. 또한 본 라이선스는 자유 소프트웨어가 아닌 프로그램을 상대로 경쟁하는데 있어 다른 자유 소프트웨어 개발자들에게 이점을 덜 제공한다. 우리가 많은 종류의 라이브러리에 보통의 일반 공중 라이선스를 사용하는 것은 바로 이러한 불리한 조건들 때문이다. 그러나 특수한 상황에서는 약소 라이선스가 유리한 경우도 있다.

극히 드문 예이긴 하지만, 어떤 라이브러리의 사용 폭을 가능한 넓게 유도함으로써 사실상 표준으로 만들어야 할 특별한 필요가 있을 수 있다. 이것을 가능하게 하기 위해서는 자유 소프트웨어가 아닌 프로그램도 그 라이브러리를 사용할 수 있도록 허용해야 한다. 이보다 흔한 또 한가지 예로 어떤 자유 라이브러리와 같은 기능을 지니면서 자유 소프트웨어가 아닌 라이브러리가 폭넓게 사용되고 있을 경우이다. 이 경우에 자유 라이브러리의 사용을 자유 소프트웨어에만 한정하면 거의 아무런 이득도 얻을 수 없다. 따라서 이런 경우에 약소 일반 공중 라이선스를 사용하는 것이다.

또 다른 예로, 자유 소프트웨어가 아닌 프로그램에 어떤 특정 라이브러리의 사용을 허가함으로써 보다 많은 사람들이 자유 소프트웨어를 사용할 수 있게 만드는 경우가 있다. 예를 들면, GNU C 라이브러리를 자유 소프트웨어가 아닌 프로그램에 사용하는 것을 허용하는 것은 보다 많은 사람들이 전체 GNU 운영 체제와 GNU/리눅스 운영체제를 사용하도록 유도할 수 있다.

약소 일반 공중 라이선스는 사용자의 자유를 보호하는 정도는 보다 약소하지만, 라이브러리와 링크된 어떤 프로그램을 사용하는 사용자가 라이브러리의 수정된 버전을 사용하여 그 프로그램을 실행할 수 있는 자유와 이에 필요한 수단을 가질 수 있도록 보장한다.

복제와 수정 및 배포에 관련된 구체적인 조건과 규정은 다음과 같다.“라이브러리에 기반을 둔 저작물라이브러리를 사용하는 저작물의 차이에 특별한 주의를 기울이기 바란다. 전자는 라이브러리로부터 파생된 코드를 담고 있는 저작물을 의미하는 데 반해 후자는 실행되기 위해서는 라이브러리와 결합되어야 하는 저작물을 의미한다.

복제, 배포 개작을 위한 규정과 조건

 본 라이선스 계약은 GNU 약소 일반 공중 라이선스(이하 본 라이선스라고도 칭한다.)의 규정에 따라 배포될 수 있다는 사항이 저작권자 또는 그에 준하는 정당한 권리를 갖고 있는 자에 의해서 명시된 모든 종류의 소프트웨어 라이브러리와 기타 프로그램에 대해 동일하게 적용된다. 라이선스를 양도 받는 사람은당신이라고 칭한다.

라이브러리란 소프트웨어 함수와 데이터를 함께, 혹은 개별적으로 수집해 놓은 것으로, 이 함수와 데이터의 일부를 사용하는 응용 프로그램과 링크되어 실행물을 생성하는데 편리하도록 미리 준비된 것을 의미한다.

이하에 언급되는 라이브러리는 본 라이선스에 의해 배포되는 모든 소프트웨어 라이브러리와 저작물을 의미한다. “라이브러리에 기반을 둔 저작물은 라이브러리 혹은 저작권법에 따라 라이브러리로부터 파생된 2차적 저작물을 의미한다. , 라이브러리의 전부 또는 일부를 원본 그대로 혹은 수정된 상태 및 다른 언어로 직접 번역된 상태로 포함하는 저작물을 뜻한다. (이후로 번역은 별다른 제한 없이 수정이라는 용어에 포함되는 것으로 간주한다)

저작물의소스 코드저작물에 수정을 가하는데 적절한 형식을 의미한다. 라이브러리에 대한 완전한 소스 코드란 라이브러리에 포함된 모든 모듈들의 소스 코드 및 이와 관련된 모든 인터페이스 정의 파일, 그리고 라이브러리의 컴파일과 설치를 제어하는데 사용된 모든 스크립트를 의미한다.

복제, 배포, 수정을 제외한 다른 행위는 라이선스의 적용을 받지 않으며 범위를 벗어난다. 라이브러리를 사용하여 프로그램을 실행시키는 행위는 제한을 받지 않으며, 그러한 프로그램의 결과물은 내용이 라이브러리에 기반을 저작물을 구성하는 경우에 한해서만 라이선스의 적용을 받는다. 그것이 라이브러리를 도구로 사용하여 생성된 것인지 여부는 관계 없다. 이에 대한 판단은 라이브러리의 역할 라이브러리를 사용하는 프로그램의 역할을 토대로 이루어진다.

 당신은 라이브러리의 완전한 소스코드를 양도 받은 원본 그대로 복제 배포할 있다. 이는 어떤 매체로도 가능하며, 다음과 같은 조건들을 전제로 한다. , 분명하고 합당한 방식으로 복제본에 적절한 저작권 고지와 보증책임이 없음을 명시하고, 라이선스를 언급하는 고지사항과 모든 보증책임의 부재와 관련된 고지사항을 원본 그대로 유지하고, 라이브러리를 양도 받는 자에게 라이선스의 복사본을 제공해야 한다.  

당신은 복제본을 물리적으로 인도하는데 소요된 비용을 청구할 있으며, 선택 사항으로 유료 보증을 설정할 있다.

당신은 라이브러리의 복제본 전부나 일부를 수정할 있으며, 이를 통해서 라이브러리에 기반을 저작물을 만들어낼 있다. 이러한 수정본이나 저작물은 다음의 사항들을 모두 충족시키는 조건에 한해서, 1조의 규정에 따라 복제 배포할 있다.

a) 수정된 저작물은 소프트웨어 라이브러리의 형태이어야 한다.

b) 파일을 수정했다는 사실과 날짜를 파일에 명시해야 한다.

c) 저작물 전체에 대한 라이선스를 라이선스의 규정에 따라 3 누구에게나 무상으로 허용해야 한다.

d) 수정된 라이브러리에 포함된 기능이 그 기능을 사용하는 응용 프로그램으로부터 제공되는 함수나 데이터 테이블을 참조하는 경우에는, 이러한 기능이 호출되었을 때 매개 인수를 전달하는 경우를 제외하고는 응용 프로그램이 그러한 함수나 테이블을 제공하지 않는 경우에도 기능이 독립적으로 수행되고 목적하는 모든 부분이 유효하게 실행될 수 있도록 최대의 노력을 기울여야 한다.

(예를 들면, 라이브러리 내의 제곱근 연산 함수는 응용 프로그램으로부터 완전히 독립적인 명확한 형태의 목적을 지닌다. 따라서 제2 d항은 이 함수에 의해 사용되는 어떤 테이블 및 응용 프로그램이 제공하는 함수라도 필수가 아닌 선택사항이 되어야 한다고 요구한다. , 응용 프로그램이 기능을 제공하지 않을 경우라도 제곱근 연산 함수는 제곱근을 구할 수 있어야 한다.)

이러한 조건은 수정된 라이브러리 전체에 적용된다. 만약 수정된 라이브러리의 특정 부분이 라이브러리로부터 파생된 것이 아니며 그 자체로 독립적인 별도의 저작물로 인정될만한 상당한 이유가 있을 경우, 해당 저작물의 개별 배포에는 이 규정들을 적용하지 않도록 한다. 그러나 이와 동일한 부분이 라이브러리에 기반을 둔 어떤 전체 저작물의 일부로서 배포된다면, 저작물 전체의 배포는 본 라이선스의 규정을 따라야 한다. 본 라이선스는 각 부분의 개별적인 저작권에 상관없이 전체 저작물에 대한 사용권한을 다른 수취인들에게 확장한다.

따라서, 본 조항의 목적은 당신이 제작한 저작물에 대한 권리를 침해하거나 인정하지 않으려는 것이 아니라, 라이브러리에 기반한 2차적 저작물이나 결합저작물의 배포를 통제할 수 있는 권리를 행사하기 위한 것이다.  

또한, 라이브러리에 기반을 두지 않은 다른 저작물을 라이브러리, 혹은 라이브러리에 기반을 둔 저작물과 함께 단순히 저장하거나 배포하기 위한 목적으로 동일한 매체에 모아 놓은 집합물의 경우에는 라이브러리에 기반을 두지 않은 저작물에는 본 라이선스가 적용되지 않는다.

3.

 당신은 양도받은 라이브러리의 복제물에 본 라이선스 대신 GNU 일반 공중 라이선스의 규정들을 적용시킬 수 있다. 이를 가능케 하기 위해서는 본 라이선스를 언급하는 모든 사항들을 GNU 일반 공중 라이선스 버전2의 사항들로 대체시켜야 한다. (만약 GNU 일반 공중 라이선스 버전 2 이후에 신규 버전이 공표되었을 경우에는 원한다면 신규 버전을 사용할 수 있다.) 그 외에 다른 사항들은 변경할 수 없다.

복제물에 대해 이러한 수정이 이루어졌을 경우에는 라이선스를 다시 변경하는 것은 불가능하며, 따라서 해당 복제물을 기반으로 만들어진 모든 저작물과 복제물에는 GNU 일반 공중 라이선스가 적용되어야 한다.

이러한 선택 사항은 라이브러리의 코드 일부분을 라이브러리가 아닌 프로그램에 포함시키고자 할 경우에 유용하다.

4.

 1조와 제2조의 규정에 따라 라이브러리(또는 제2조에 의한 라이브러리의 일부나 라이브러리에 기반한 2차적 저작물)를 오브젝트 코드나 실행물의 형태로 복제 및 배포할 수 있다. , 이때 컴퓨터가 인식할 수 있는 완전한 소스 코드를 제1조와 제2조의 규정에 따라 소프트웨어의 교환을 위해서 일반적으로 사용되는 매체를 통해 함께 제공해야 한다.

오브젝트 코드를 지정된 장소로부터 복제해 있게 하는 방식으로 배포할 경우, 동일한 장소에서 소스 코드를 복제할 있도록 동일한 접근방법을 제공한다면 이는 소스 코드가 오브젝트 코드와 함께 복제되도록 설정하지 않았다고 하더라도 소스 코드를 배포하는 것으로 간주된다.

 라이브러리의 어떠한 부분으로부터의 파생물도 포함하지 않지만, 컴파일이나 링크를 통해서 라이브러리와 함께 작동되도록 설계된 프로그램은 라이브러리를 사용하는 저작물로 칭한다. 이러한 저작물이 별도로 분리되어 있을 때는 라이브러리로부터 파생된 저작물이 아니며, 따라서 본 라이선스의 범위를 벗어난다.

그러나 라이브러리를 사용하는 저작물을 라이브러리와 링크로 연결한 결과로 생성된 실행물은 라이브러리의 일부를 포함하고 있기 때문에 라이브러리에서 파생된 2차적 저작물이 된다. 따라서 이 실행물은 본 라이선스의 적용을 받는다. 6조는 이러한 종류의 실행물의 배포에 대한 규정을 다루고 있다.

라이브러리를 사용하는 저작물이 라이브러리의 일부인 헤더 파일의 자료를 사용하는 경우에는 비록 그 저작물의 소스 코드가 라이브러리로부터 파생한 2차적 저작물이 아니었다 하더라도 오브젝트 코드는 라이브러리로부터 파생한 2차적 저작물이 될 수 있다. 이러한 구분이 성립되는지 여부는 그 저작물 자체가 라이브러리일 경우나 라이브러리 없이도 링크될 수 있는 저작물일 경우에 매우 중요한 의미를 갖는다. 이러한 구분이 성립되는 기준이 법적으로 정확하게 정의되어 있는 것은 아니다.

만약 이러한 형태의 오브젝트 파일이 단지 숫자 매개 변수와 데이터 구조의 설계 형태 및 접근 도구, 그리고 10행 이하로 이루어진 작은 인라인 함수와 매크로만을 사용한다면, 법적으로 그것이 2차적 저작물을 성립하는지 여부와 관계없이 그 사용이 제한되지 않는다. (그러나 이러한 오브젝트 코드와 라이브러리의 일부를 함께 포함하는 실행물은 제6조의 적용을 받는다.)

라이브러리에서 파생된 2차적 저작물에 대해서는 그 오브젝트 코드를 제6의 규정에 따라 배포할 수 있다. 또한 이러한 저작물을 포함하는 실행물들은 라이브러리 자체와 직접 링크로 연결되었는지 여부와 관계없이 전부 제6조의 적용을 받는다.

 위의 조항들에 대한 예외적 경우로 라이브러리를 사용하는 저작물을 라이브러리와 결합하거나 링크로 연결하여 라이브러리의 일부를 포함하는 저작물을 생성하고 그 저작물을 임의로 선택한 규정에 따라 배포할 수 있다. , 이 경우 배포 규정에는 수취인들이 필요에 따라 저작물을 수정할 수 있으며 수정에 따른 디버깅을 위한 코드 역분석(reverse engineering)을 할 수 있다는 내용이 포함되어야 한다.

저작물의 복제본을 배포할 때는 저작물 내에 라이브러리가 사용되고 있다는 사실과 라이브러리 및 라이브러리의 사용에 대해 본 라이선스가 적용된다는 내용의 안내 문구를 각 복제본에 명확하게 고지해야 한다. 저작물이 실행되는 도중에 저작권 사항이 표시되는 경우에는, 라이브러리에 대한 저작권 사항도 함께 포함시켜야 하며, 본 라이선스의 사본을 참고할 수 있는 방법을 명시해야 한다. 또한 다음 중 하나의 사항을 반드시 충족시켜야 한다.

a) 저작물에 포함된 라이브러리에 어떠한 수정이 가해졌다 하더라도, 해당 라이브러리에 대한 완전한 소스 코드를 컴퓨터가 인식할 수 있는 형태로 저작물과 함께 제공해야 한다. 이는 위의 제1조와 제2조의 규정에 따라 배포되어야 한다. 만약 저작물이 라이브러리와 링크되는 실행물일 경우에는 컴퓨터로 인식할 수 있는 완전한라이브러리를 사용하는 저작물을 오브젝트 코드와 소스 코드 모두 혹은 둘 중 하나의 형태로 저작물과 함께 제공하여 사용자가 라이브러리를 수정한 후에도 링크를 통해 수정된 라이브러리를 포함하는 새로운 실행물을 생성할 수 있도록 해야 한다. (라이브러리 내의 정의 파일의 내용을 변경한 사용자가 반드시 수정된 정의 부분을 사용하기 위한 응용프로그램을 컴파일 할 수 있는 것은 아니다.)

b) 라이브러리는 적절한 공유 라이브러리 방식을 사용하여 링크되어야 한다. 적절한 방식이란, (1) 라이브러리의 함수를 실행물 속으로 직접 복제하는 것이 아니라 실행 시점에서 볼 때 이미 사용자의 컴퓨터 시스템 상에 존재하고 있는 라이브러리의 복제물을 사용하는 방식, 그리고 (2) 사용자가 수정된 라이브러리를 설치하는 경우에도 수정된 버전이 저작물을 만들 때 사용된 라이브러리의 버전과 인터페이스 상으로 호환되는 한, 적절하게 동작할 수 있는 방식을 의미한다.

c) 배포에 소요되는 최소한의 비용만을 받고 제6조의 a)항에 규정된 자료를 배포하겠다는 내용으로 최소한 3년간 유효한 약정서를 저작물과 함께 제공해야 한다.

d) 저작물을 지정한 장소로부터 복제해 갈 수 있게 하는 방식으로 배포하는 경우, 동일한 장소로부터 위의 항에 규정된 자료를 복제해 갈 수 있는 동등한 접근방법을 제공해야 한다.

e) 사용자가 위의 항에 규정된 자료의 복제물을 이미 수령했는지, 혹은 사용자에게 그러한 자료를 이미 송부했는지 여부를 확인해야 한다.
